The Secure bike lockers website is owned and operated by Transport for NSW, which operates this website using the name 'Secure bike lockers'.

Your access to this website and information it contains is subject to these terms and conditions. Accordingly, please read these terms and conditions before you continue to use this website. These terms and conditions are referred to as 'the Terms' and by using this website you agree to be bound by the Terms. If you do not want to be bound by the Terms, do not continue to use this website.

1. Definitions

(a) "Content" means all of the content featured or displayed on the Website, including, but not limited to, text, graphics, photographs, images, moving images, sound, illustrations, data, files, other information and software.

(b) "You" means, even where not capitalised, a person who uses the Website or, if a person using the Website is doing so in his or her capacity as an employee or representative of someone else, then it refers to that employer or principal as well.

(c) "Website" means the whole or any part of the website pages located at https://bikelocker.transport.nsw.gov.au/ (including the layout of the website, graphic design elements of the website pages, underlying code elements and any text, graphics, sounds, animated elements or other Content of the website).

2. Intellectual Property

The content displayed or provided on the Website belongs to Transport for NSW and is protected by copyright, trade mark and/or other intellectual property laws in Australia and elsewhere ("IP Rights"). Your right of access to the Content, which is governed by the terms and conditions of the Terms, does not grant you any IP Rights in the content.

Unless otherwise expressly stipulated by Transport for NSW, you may only use the Website for your personal use and may only print or make an electronic copy of information available on the Website for that purpose. You must not sell or otherwise commercially exploit any information made available on the Website.

If you breach any of these conditions, then (without limiting your other liabilities) your authorisation to use the Website automatically terminates and you must immediately destroy any downloaded or printed materials.

By submitting any material to the Website or to Transport for NSW in connection with your use of the Website, you thereby assign all IP Rights in that material to Transport for NSW. You must not submit material to the Website if a third party has any IP Rights in that material (and it has not provided its express consent to such assignment).

3. Your Conduct

In using this Website you agree:

(a) not to disrupt or interfere with any other user's enjoyment of the Website;

(b) not to upload, post or otherwise transmit any viruses, malicious computer code or other harmful files through the Website; and

(c) not to disrupt or interfere with the security of or otherwise cause harm to the Website.

4. Links to Third Party Websites

The Website may contain links to external websites operated by third parties. Such websites are not under the control of Transport for NSW and Transport for NSW cannot accept any responsibility for the contents of any such site. Any link to an external website is provided merely as a convenience to you. Some external websites may be co-branded by Transport for NSW, displayed within the Website frames, include some of the content, or include reciprocal links to the Website - these features are for your convenience and do not mean that we are endorsing the sites or the content of such sites. If you use any such external links, you take sole responsibility for the use of the external websites.


5. No guarantee of protection

While we endeavour to ensure that the Website is free from viruses and other harmful code, we cannot guarantee this. We therefore recommend that you install and use up-to-date anti-virus, anti-spyware and firewall software on your computer.

6. User name and password

You must keep your username and password confidential. You must not disclose this information to any person, and we are not responsible for any loss suffered as a result of you disclosing any such information to another person. Where you are logged into the Website using your username and password, you will be automatically logged out after a period of inactivity to help reduce the risk of anyone else accessing your account. For the same reason, you should log out when you have finished using the Website. 

7. Privacy

Under the Privacy and Personal Information Protection Act 1998 (NSW), you have the right to know the information that Transport for NSW collects about users of its Transport for NSW website, the purpose for which the information is collected, how the information is used and to whom, if anyone, the information is to be disclosed. This information may include details that you provide when you submit feedback on public transport information services via this website, such as your name, address, telephone number or email address.

8. Multi-factor authentication 

Multi-factor authentication is a method of authentication that requires the use of more than one factor to verify a user's identity.
To enhance security, you understand and agree that multi-factor authentication is required to access and use the Website. You understand you will be required to verify your identity by either:

(a) a SMS two factor authentication;
(b) an email two factor authentication; or
(c) via a multi-factor authenticator app on your mobile device.

It is a condition of the terms of use of the Website that all users utilise multi-factor authentication. If you do not agree to the use of multi-factor authentication, you will not be able to access the Website and you must not use the Website.

You understand and agree that you will be required to enter an SMS authentication code, email authentication code, or time-based one-time passcode generated by an authenticator app to:

(d) log in and access the Website;
(e) view or update your personal details on the Website, including email addresses and contact information;
(f) changing or removal of Opal card number;
(g) changing of passwords;
(h) confirmation and removal of multi-factor authentication mechanisms; and
(i) early termination of locker hire.

If you change your mobile phone number or email address, you must advise us immediately. To ensure that any email or SMS authentication codes that we send you are kept secret and secure, we recommend that you provide us with an email address or mobile phone number that is only used by you.

We will handle personal information that we collect via this Website in accordance with our privacy clause above.

9. Accuracy of Information and Limitation of Liability

Transport for NSW does not warrant the accuracy, completeness or currency of information that is made available through the Website. Transport for NSW will not be liable for or in connection with any loss or damage arising from any inaccuracies, errors or omissions in information made available through the Website. However; Transport for NSW will endeavour to ensure that information is updated as soon as practicable when it becomes aware that material changes have occurred.

Transport for NSW makes no warranty that your access to, or use of the Website or the functions contained on the Website will be uninterrupted or error free, that any defects will be corrected or that the Website or the server which stores and submits content to you via the Website is free of viruses, malicious computer code or other harmful files transmitted on or through the Website.

Use of the Website is at your own risk. Subject to the Terms, you assume full responsibility and risk of loss resulting from your downloading, use of, or access to the content or other material on or through the Website.

To the extent permitted by law, Transport for NSW will not be liable for any damages whatsoever, of any kind, including (but not limited to) loss of profits, loss of or damage to goodwill or other expectation benefit or liability to any third party, that are directly or indirectly related to the use of, access to, or the inability to use or access, the Website or any content provided on it or through it, even if advised of the possibility of such damages or that such damages were foreseeable.

10. Termination

Transport for NSW can terminate the operation of and/or access to the Website at any time at its own discretion.

11. Amending the Terms

Transport for NSW reserves the right to amend the Terms, and any additional terms and conditions, from time to time at its sole discretion. Your use of the Website will be subject to the most current version of the Terms posted on the Website at the time of such use.

12. Jurisdiction

The Terms will be governed by and interpreted in accordance with the laws of New South Wales, Australia.

13. Severance

Any Term which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity or enforceability of the remainder of these Terms will not be affected.

14. Complaints

If you have a complaint about our Website, please submit feedback via the transportnsw.info, or call 131 500, and clearly describe the circumstances of your complaint. We will get back to you as soon as we can, after investigating your complaint.
